Data Protection Declaration

This Data Protection Declaration made by helvetic-assistance.ch, an offering from Helvetic Assistance GmbH, informs you about how we and affiliated companies deal with data that is processed about you, whether in the use of our websites and mobile applications or in any other way. Regarding these portals, we are responsible for the processing of your personal data and compliance of data processing with current legislation. In doing so, we comply with the applicable data protection regulations.

“Personal data” are all individual details about personal or factual circumstances relating to a specific or identifiable natural person. This means that it is information that can be personally assigned to you and can say something about you. In this data protection provisions we will refer to this as “your data”. “Processing” means any handling of your data, in particular the collection, storage, administration, use, transmission, disclosure or deletion of your data.
Please note that the following statements may be adjusted from time to time. We therefore recommend you consult this Data Protection Declaration regularly. Third party websites accessible through our portals are not subject to the principles set forth herein. We assume no responsibility or liability for the observance of data protection by third party websites.

Below, we inform you about what personal data of yours we collect and store, when you use our portals, and how we use this data and to whom we can pass on this data, where necessary. In addition, you will receive information about what rights over us you have with regard to the use of your data:

1 Scope and purpose of processing personal data

1.1 When visiting our portals

If you use our digital offerings without further comment then the web server technology we use automatically logs general technical visit information in so-called log files. This includes, among other things, the IP address of the device used in making the visit, information about the browser type, the Internet Service Provider and the operating system used, which of our digital offerings were consulted, reference / exit pages, the time and duration of the visit.

The purpose of collecting and processing this information is to facilitate the use of our websites (ease of connection), to ensure system security and stability, to analyse the use of our services and offerings, to collect general population information and to optimise our website (in particular, but not exhaustively, product improvements, marketing efforts, target group-specific advertising, etc.), as well as for internal statistical analysis. During this process, the identity of the user is not established. Similarly, absolutely no connection is made between this automatically generated information and the personal data held by us. An exception to this basic rule exists nevertheless, when you are already a registered user on one of our portals. You can also obtain free services on our portal. Your personal data (e-mail address, telephone number, etc.) that may be disclosed in using a free service or with a message may, for example, be used by us for marketing and analysis purposes. Further information on processing personal data for marketing and analysis purposes can be found below in section 4.

We can publish information input by you on our portal, on other platforms as well as in other media (such as print media, if necessary in an adapted form). In addition, we use cookies and analysis tools (such as Google Analytics) when visits are made to our portals. Please refer to sections 8 and 9 of these data protection provisions.

1.2 When using a paid service

If you use a facility on our site, or a paid service, then you are required to enter data such as first and last name, address (full postal address, postcode, town or city) and sometimes other data, since we use this for execution of the contract with you. If, when purchasing a product or a paid service, you opt for online payment such as a credit card or PayPal, then payment is made with the online payment system of that service provider. In such cases, the processing of personal and payment data is done directly through them. We do not know, nor do we store your payment details. In addition, the data protection provisions of the online-payment provider shall apply. In any event, we do store all information relating to your current and previous contracts, i.e. products and services. You hereby consent to our using this information for marketing and analysis purposes. Sensitive personal data and personality profiles may come to light in the course of analysing your user and purchasing behaviours.

1.3 Consent

By inputting and modifying your information, you consent to the editing, usage and disclosure of that information in the ways and scope that are set out in this Data Protection Declaration.

1.4 Contact form

Should you send us questions via the contact form, we will collect the data entered on the form, including the contact details you provide, to answer your question and any follow-up questions. We do not share this information without your permission.

We will, therefore, process any data you enter onto the contact form only with your consent. You may revoke your consent at any time. An informal email making this request is sufficient. The data processed before we receive your request may still be legally processed.

We will retain the data you provide on the contact form until you request its deletion or revoke your consent for its storage, or until the purpose for its storage no longer pertains (e.g. after fulfilling your request). Any mandatory statutory provisions – especially those regarding mandatory data retention periods – remain unaffected by this provision.

2 Email marketing / Online marketing

By registering on one of our portals you consent to your personal data being used also for customised marketing initiatives. This applies both to the customisation of email marketing, such as emails of a general or advertising character (newsletters) and the insertion of customised content and advertising on our portals. When doing so, we can automatically make use of known information relating to your usage behaviour on our portals.

If you have subscribed to our newsletter, you may, at any time, use the appropriate link or send an email to info@helvetic-assistance.ch so as to cancel your subscription. Cancellation is possible at any time. We have the right to entrust third parties with carrying out marketing initiatives and may pass your data on to them for this.

3 Disclosure of your data to third parties

We work together with other companies or persons, or else entrust other companies or persons with the processing or storage of data. These parties may obtain access to your personal data, but only insofar as is necessary for carrying out their assignment.

We may use and disclose information input by you, and personal data collected during our usage measurements, for the purpose of evaluating, improving and customising our services or the services of affiliated companies, for customer care, for personalisation and for marketing purposes.

Furthermore, we pass on your information to third parties, insofar as this is necessary for contract execution. For this purpose, we do, in any event, disclose the necessary information to other service providers. These service providers make use of your data exclusively for carrying out their assignment and for no other purpose. The personal data you provide to us is neither sold on, leased out nor negotiated.

Apart from the disclosures described above, we only pass on your personal data if you have expressly consented to this, if there is a legal obligation to do so, or if this is necessary to enforce our rights, in particular to assert claims arising from the contractual relationship.

In the event of a sale, merger or other reorganisation of some or all of our Company’s assets, personal information may be transferred, sold or otherwise shared with third parties as part of that transaction or reorganisation. If we make an advance payment, for example, if we purchase on account, we may, in order to safeguard our legitimate interests, obtain credit information from an information agency on the basis of mathematical-statistical procedures. For this purpose, we will transmit the personal data required for a credit check to an information agency and use the information received on the statistical probability of a default in taking any decision on the establishment, implementation or termination of the contractual relationship with you. Such credit information may contain probability values (score values), calculated on the basis of scientifically recognised mathematical-statistical procedures and using, inter alia, address data. Your legitimate interests are taken into account and protected in accordance with statutory provisions.

4 Processing of your personal data for marketing and analysis purposes

Helvetic Assistance GmbH aims to continuously improve the digital services it offers and to tailor them to your needs. For this purpose, user-specific historical and future data that we have at our disposal, can be continuously linked using different analysis tools, and user-behaviour analysed across all offerings. The findings from the use you make of our offerings can be used and employed as part of the analysis of user-behaviour at other participating companies. The steps leading to deactivation of cookies need to be followed to completely exclude or at least reduce the collection of personal data. Doing this may mean that you can no longer obtain or use the services you have purchased.

5 Transfer of personal data abroad

We are also entitled to transfer your personal data to third parties (contracted service providers) abroad, provided this is appropriate for the data processing described in this Data Protection Declaration. These parties are obliged to respect data protection to the same extent as we are. If data protection in that country is not the same as in Switzerland then we ensure, by contract, that the protection of your personal data corresponds to that in force in Switzerland.

6 Right to information, correction or deletion

You have the right to assert your data protection rights at any time and to request information about whether, and what personal data about you, are processed by us. You may also have your personal data rectified, blocked or deleted at any time by tendering written notice with proof of your identity to the following address: info@helvetic-assistance.ch. We reserve the right, in such cases, to enter into correspondence with you. Please note that even after your request for blocking or deletion of your personal data, we must retain that data partially within the scope of our statutory or contractual retention obligations (e.g. for billing purposes) and therefore merely block your personal data, to the extent this is necessary. Furthermore, deletion of your personal data may mean that you can no longer obtain or use the services you have registered for.

7 Data security

We use appropriate technical and organisational security measures to protect your personal data stored with us against unintentional, unlawful or unauthorised manipulation, deletion, modification, access, disclosure or use, and against partial or total loss. Our security measures are constantly modified and improved to reflect developments in technology. We cannot be liable for the loss of data or the obtaining and use of data by third parties. Payment and access information should always be kept confidential. You should close your browser window when you end your session with us, especially if you share your computer with others. We also take data protection within our organisation very seriously. Our staff and the service companies we engage are subject to secrecy and are bound to comply with data protection legislation.

8 Web analytics and cookies

When you use helvetic-assistance.ch, we automatically collect metadata about your website visit. This includes, for example your browser, your device type (e.g. smartphone or tablet), how you came to helvetic-assistance.ch (campaign and referral information), how long your visit took and your IP address. In addition we log what content you call up on helvetic-assistance.ch and how you interact with our website and with other applications on our website (digital offerings). We do this with a view to improving our website and our offerings so as to better adjust your experience on helvetic-assistance.ch to suit your needs. We make use of tools provided by third party providers, e.g. webtrends, to store and analyse data.

We use cookies in the process for displaying our digital offerings. Cookies are small text files that are lodged in your browser and/or in your device and which let us know each time you re-connect to helvetic-assistance.ch or another one of our digital offerings. These also contain an anonymous user ID which means we can recognise you again on your next visit. This is the only way we can continuously improve our digital offerings and make available to you time-saving and comfortable functions such as picking up an existing premium quote or the personalisation of content. In doing this we are careful only to store as much information as is necessary. If you do not agree with this, you can configure your browser not to accept cookies from helvetic-assistance.ch. Generally speaking, you can continue to use our digital offerings but, in some circumstances, certain functions may be available to you only in limited form, or not all.

Furthermore, we integrate technologies from external providers into our digital offerings. As part of our business relationship, we transmit data to them on your interaction with helvetic-assistance.ch and our digital offerings. This may, for instance, be technologies from advertising service providers such as Google (Google AdWords and Google Remarketing). In doing this we are careful only to communicate anonymous data. Generally speaking, cookies are also used in data storage, and this lies within the area of responsibility of our external service providers.

9 Usage of social plug-ins

Our website uses «social plug-ins» (hereinafter: plug-ins) linked to social networks on the Internet. These plug-ins are each displayed with the logo of the corresponding network. When you connect to a website that has one of these plug-ins, a direct connection is set up with the servers of the corresponding social network. From that point in time you are logged in to that network with your user name and password and the network is automatically informed that you are visiting our site. This information can be filed in your user account with them. In addition, when you interact with plug-ins (for instance clicking on «like» or «share» in Facebook or «tweet this» in Twitter) then the content of our webpages are linked to your profile in that social network. Other users of that network can learn of your interaction. Helvetic Assistance GmbH is not in any way connected to these third party providers whose websites are linked by plug-ins, and we are not liable for these. Even if you are not a subscriber to that social network or are not logged in there, it is still possible that your IP address is communicated to them and stored.

Specific data protection guidelines and liability provisions exist for third party providers’ websites linked by plug-ins. The storage and use of your data by these website administrators can exceed the scope of Helvetic Assistance GmbH’s Data Protection Declaration. We are not aware of the purpose and extent of their data collection and subsequent data processing and usage – and have no influence over this. You should seek your own information on the third party administrator’s data protection guidelines.

11 Updating and alterations to these data protection provisions

It may be necessary to alter these data protection provisions in the light of further developments of our website or the implementation of new technologies. Any significant alteration to these data protection provisions will be notified to users by email sent to the email address given when registering or by a clear message at an appropriate location when logging in to one’s user account. An up-to-date version of these data protection provisions can be called up at any time and printed off on our website. The original of this Data Protection Declaration is in the German language.
